The following Terms and Conditions govern the use of the website and our products and services offered, provided or sold through the website, as well as information you obtain from Desert Sound Audiology, whether from the website, by telephone or email or through other means of communication with us. Therefore, any references in these Terms and Conditions to the “website” are meant to include any such products, services, information and communications from or with Desert Sound Audiology. By accessing or using the website or any information, products or services from the website, you agree to be bound by and to comply with these Terms and Conditions.

Desert Sound Audiology reserves the right to refuse service or the sale of products at any time, consistent with applicable law. Subject to these Terms and Conditions, Desert Sound Audiology grants you a limited, non-exclusive, non-transferable, non-sublicenseable right to access and use the website for the purpose of scheduling and conducting online hearing assessments arranged through Hometown Hearing, ordering products from Desert Sound Audiology and otherwise accessing and using any functionality, information and services made available by Desert Sound Audiology through the website. We retain and reserve all of its rights on the website and, except as expressly provided above, no rights or licenses in or to the website or any other intellectual property of Desert Sound Audiology are granted or provided, hereunder, by implication, estoppel or otherwise.

The website may not be used for purposes that are unlawful, in violation of any applicable laws or regulations or contrary to these Terms and Conditions. If Desert Sound Audiology refuses or discontinues service to you after you have purchased its products, Desert Sound Audiology “Standard Return Policy” and “Return Policy Based on Medical Opinion” described below may apply. If you are not entitled to a refund under Desert Sound Audiology policies, you may, in your discretion, keep your product, but you will no longer be eligible for services Desert Sound Audiology has refused or discontinued.

Desert Sound Audiology reserves the right, without undertaking an obligation, to submit any information provided by you, without subpoena, to law enforcement agencies and/or any credit card company for fraud investigation. Desert Sound Audiology reserves the right to cooperate with authorities to prosecute such offenders to the fullest extent of the law.
